Recently, the State Administration for Market Regulation of the PRC released the revised Implementation Measures for the Administration of Enterprise Name Registration on its official website. The revised implementation measures will come into force from 1 October 2023. The main changes of the revised version are as follows:
Enterprise Name without Administration Region
The name of an enterprise that satisfies the following conditions can be registered without administrative region:
(1) Registered Enterprise;
(2) Invested and established companies with the same business name as the enterprise and have been operating for one year or more in three or more provincial administrative regions; or
(3) Other situations that comply with laws, administrative regulations, and regulations of the State Administration for Market Regulation.
Enterprise Name without Industry
The name of an enterprise that satisfies the following conditions can be registered without industry or business characteristics:
(1) Registered enterprise with a business scope covering five or more industries of the national economy;
(2) Invested and established three or more companies with the same business name as the enterprise and have been operating for one year or more;
(3) The industries or business characteristics of the invested companies belong to different industries of the national economy.
Enterprise Name with the Wording of Group
The name of an enterprise that satisfies the following conditions can be registered with the wording of group:
(1) For registered enterprise that controls three or more enterprises, the wording of "group" or "(group)" can be used before the organizational form of the enterprise name.
(2)Subsidiaries and participating companies authorized by the parent company of the enterprise group can use the name of the enterprise group in their own names.
