According to the relevant Cambodian laws and regulations, Cambodian enterprises intending to hire foreign employees are required to apply for a foreign employee quota from the Ministry of Labour and Vocational Training in advance annually. In general, the quota application for the use of foreign employees in the following year shall be submitted to the Ministry of Labor and Vocational Training no later than November 30 of each year.
The window to apply for the 2023 foreign employee quota is open now until 30 November 2022. Enterprises planning to employ foreign employees in 2023 shall arrange to submit their application for foreign employee quota to the Ministry of Labour and Vocational Training as soon as possible. Without an approval on foreign employee quota for 2023, the enterprises are not allowed hire foreign employees and apply for work permits for them.
Under the quota system, a Cambodian enterprise can only have a maximum 10% of its total workforce for the use of foreign employees, which comprises:
office employees: no more than 3%
skilled labour employees: no more than 6%
unskilled labour employees: no more than 1%
Enterprises that need to hire employees but are not able to find suitable and qualified Cambodian nationals to fill the required positions, may hire foreign employees in exceed of 10% of their total number of employees after obtaining an approval from the Ministry of Labour and Vocational Training.
