According to a reply on the approval of temporary adjustments to some administrative regulations in Hainan Free Trade Port, which released on 2 November 2023 by the State Council of the PRC, from now on, if an overseas certification institution will only conduct certification for export products in Hainan Free Trade Port, it is not required to obtain the qualification for certification institution and register a business entity in Hainan. The certification institution can conduct business in export products certification upon completion of a record filing with the certification and accreditation supervision and administration department under the State Council of the PRC. But the certification result can only be used overseas by the export enterprise.

The above adjustments are undoubtedly a positive news for overseas certification institutions that planning to engage in the relevant certification activities in Hainan Free Trade Port. Upon the implementation of the new policies, overseas certification institutions will not be required to establish subsidiaries in Hainan and obtain the qualification for certification institution in China. They only need to complete a record filing with the competent certification and accreditation supervision and administration department of the PRC before they conduct the relevant certification business activities in Hainan Free Trade Port. This will greatly reduce the operating costs and time costs of overseas certification institutions in Hainan.

Currently, the record filing conditions and procedures for overseas certification institutions have not been released yet. The detailed rules will be formulated and released by the certification and accreditation supervision and administration department under the State Council of the PRC.
